What can be patented?

Inventions that are novel, non-obvious, and useful can be patented. This includes processes, machines, manufactured items, and compositions of matter, as well as improvements to existing inventions.

How long does patent protection last?

Utility patents typically last 20 years from the filing date. Design patents last 15 years from the date of grant. Maintenance fees must be paid for utility patents to remain in force.

What rights does a patent provide?

A patent gives the owner the exclusive right to prevent others from making, using, selling, or importing the patented invention without permission.

How do I know if my invention is patentable?

You should consult a patent attorney to conduct a prior art search and evaluate whether your invention meets the criteria of novelty, non-obviousness, and utility.

Who can apply for a patent?

The inventor(s) of the invention must apply, or their legal representative. In the U.S., patents can also be assigned to companies or organizations.

Is a patent valid in every country?

How are patent rights enforced?

Patent rights are enforced through civil litigation. If someone infringes on your patent, you may file a lawsuit in federal court to seek damages or an injunction.

Can I file a patent application myself?

Yes, you can file a patent application pro se (without an attorney), but it is strongly recommended to consult a patent attorney to ensure your application is complete, accurate, and enforceable.
